U.S. Supreme Court considers youth serving life without parole

According to a news release from the Human Rights Watch, the United States is the only country that locks up persons under the age of 18 for life without parole, an astonishing degree of cruelty. Their report on this issue can be downloaded in pdf format here.

Of course, all this begs the question, are we just confusing ourselves because of our artificial and erroneous understanding of the appropriate age of legal capacity? We set it at 18 but should it be more like 12?
